Liberty County Jail- CEC Jail Corporation Management in The News Again. Female Prisoner Files Notice of Suit...

Email from Liberty Dispatch to Wes Hinch, Liberty County Attorney-

Sent: Thursday, September 13, 2012 2:10 PM
Subject: Lawsuit against Liberty County -OBrien Case

Dear Wes,

Liberty County continually keeps getting sued because of the illegal behavior of CEC, Timothy New and many others.  CEC has severely damaged Liberty County in ways that may never be able to be repaired, the madness has to stop. Until the county can take back the jail decisive action has to be taken by Liberty County to make a stand against the aforementioned.  Warden Timothy New and others' lies have even unwittingly drawn one of our Honorable District Judges into their crimes/perversions- this is very disturbing.

If Liberty County is sued 'again' based on the actions of CEC etal, Liberty County needs to suborgate each new claim by counter-suing CEC each time Liberty County gets sued.

Please advise your action.

Liberty Dispatch

Response from Wes Hinch to Liberty Dispatch-

Dear Liberty Dispatch,

The allegations made by Ms. Obrien are very serious and have been treated that way.  My office promptly notified the Texas Rangers of this claim, seeking a full investigation.  I have been advised that an investigation is underway.  Moreover, as noted in Mr. Lavalle's letter, the FBI and Texas Rangers were made aware of Ms. Obrien's claims in 2011.  I believe that Liberty County officals and those investigating Ms. Obrien's claims appreciate that the integrity of our entire criminal justice system depends upon the integrity of each individual involved in the process.  Consequently, these claims are not taken lightly.

In addition to confirming law enforcement awareness of the claim, I have notified Liberty County's insurance carrier and demanded indemnification from CEC.  Pursuant to Article 11 of the attached contract, CEC is obligated to indemnify and defend Liberty County from claims resulting from its operation of the Liberty County Jail.

Thank you for your concern.

Regards,
W.N. Hinch

Commentary-

Liberty Dispatch appreciates the interest and quick action of Liberty County Attorney Wes Hinch.  After years it appears Mr. Hinch has settled into his job and become an advocate for Liberty County.

Story and Allegations:

Attorney Paul H. LaValle of Texas City has sent a letter to Liberty County Attorney Wes Hinch, Warden Tim New of the Liberty County Jail, County Judge Craig McNair and Sheriff Henry Patterson that he has noticed Liberty County and others that he will file a law suit seeking 10 million dollars in damages on behalf of his client Ms. Brandy O’Brien who was previously incarcerated in the Liberty County Jail.

During O’Brien’s incarceration in June of 2012 O’Brien and her attorney claim that she was forced to perform oral sex on Chief Kenney Nunn on at least four occasions and was also forced to have sexual intercourse with Chief Nunn on at least five other occasions. Additionally the notice goes on to state that Chief Kenny Nunn performed oral sex on Ms. O’Brien on one occasion.

Furthermore the letter goes on to state, It is no secret that Chief Kenny Nunn has been previously fired from the jail for getting a female prisoner pregnant. According to the notice, Chief Kenny Nunn has been investigated numerous times due to complaints from other female prisoners alleging he is a sexual predator. Apparently Warden New, not only condones but encourages this behavior of his jail employees.

Now CEC's scumbag attorneys will go to work punching holes in this case like they do all other cases. They would rather pay some scumbag hacks several hundred thousand dollars instead of having to pay millions in damages.

Timothy New is scum of the earth and Liberty County officials and law enforcement have known about his and others deviant sexual appetite for years and looked the other way.

Thank you LD for bringing this case and evidence forward along with your concern.

True justice would be for Timothy New to be arrested and incarcerated.

This Timothy New fellow is the one Todd Fontenot and Lee Groce liked so much, isn't he?

Sick of CEC and the armpit of a jail we have over by KSHN radio. If you have ever met these people or been in that jail you know what I am talking about.

See for yourselves Ms. O'Briens character. It appears to me as if Ms. O'Brien is up to the same antics as mentioned in the above artice. Extortion and lies. The accusations are completely unfounded and I, for one, am looking forward to the outcome of the investigation to bring to light this woman's vicious character.

Speaking of Brandy O'Brien's lies...It has also been proven that she misrepresented and lied on an official banking document in order to secure a loan for a house. How many lies can a person tell before they are held accountable for their actions?

How many more times are the Commissioners and the County Judge going to fix this flat before they come to the conclusion that they need a new tire. A blind rat could find his way out of this maze, yet our county leaders still seem to be wandering around without a clue, fully content to pay CEC their outlandish fees to keep our prisoners and allow the CEC leaders to allegedly committ these atrocities. Outlandish!!! Taxpayers will again ultimately pay for these mistakes with all the lawsuits that will follow. Maybe they can rent the new McNair Community Center out to pay for some of this.

Judge McNair and Commissioner Warner were not in office and should not be held responsible for the long track record of this CEC group that Groce and Tookie Kirkham and Todd Fontenot put in charge of our jail.

Police: Woman jailed for lying about carjacking

By Christopher Smith Gonzalez
The Daily News
Published May 4, 2012
KEMAH — A League City woman lied when she claimed she was carjacked while stuck in traffic then tied to a bed in a house in Dickinson, Kemah police said Thursday.

After a monthlong investigation by Kemah and Dickinson police, Brandy O’Brien, 32, was arrested for perjury and making a false report to a police officer.

Perjury is a Class A misdemeanor, which could lead to up to a year in jail and a $4,000 fine. A false report is a Class B misdemeanor and could lead to 180 days in jail and a $2,000 fine.

“After a thorough investigation, it was determined Brandy lied about the incident,” the Kemah police department said in news release.

O’Brien was being held in the Kemah Jail on a $4,000 bond, the release stated.

O’Brien originally told the police that while waiting for spring break traffic to move on state Highway 146, she noticed a car pull up behind her and soon after, a man jumped into the passenger side of her car and pointed a gun at her.

O’Brien claimed she was taken to a house in Dickinson, tied to a bed with sheets and held in filthy conditions before she managed to get away when the man supposedly watching over her fell asleep.

O’Brien called the police from a restaurant in Dickinson. Her car, a 2000 Jeep Wrangler, was in the parking lot of the Walgreens, 4016 state Highway 3, in Dickinson.

Police were suspicious of O’Brien’s story early on when she stopped returning calls and would not meet with detectives. O’Brien also missed an interview with The Daily News, which she had requested.

“We interviewed a bunch of people, and finally, (O’Brien) admitted she was lying,” Kemah police Sgt. James Heard said.

Heard said the police department talked to friends and associates of O’Brien.

They interviewed O’Brien last week and she admitted to lying about the incident, Heard said.

O’Brien did not say why she made up the story, Heard said. But she admitted she had not been to Kemah on the day the carjacking was supposed to have happened.

O’Brien, who runs a pet-sitting business out of Seabrook, did not return a phone call asking for comment.

McNair is the solution, not the problem.

This is one of the many reason's the Violence Against Woman Act and Hate Crimes are so awful. There is no Race, Sex or Ethnic group that does not lie. In some cases the authorities would round up innocent folks just because some one like this felt the need for attention, financial gain or to cover up some deed. When this proves to be untrue, which based on her history of serious false allegations and her extensive criminal history, any person of average intelligence would have a hard time believing anything she says. Although I do not know nor am I affiliated with any of the individuals involved, it does not seem credible based on Ms. O'Brien's extensive criminal background and the false statement previously made to Kemah Police Department. If these allegations prove to be false, I hope they not only throw the book at her but the entire library. Women like this make it difficult for the true victims of crime against women.

It appears you do know of OBrien an do have an axe to grind.

Anonymous said...

No I do not know her. I am the real victim of a REAL crime. And it infuriates me that women like this "make up" crimes and make it more difficult for the real victims to keep their credibility.

Anonymous said...

How do you know she is lying? The people she accused are well known for what she claims they did to her.

Anonymous said...

I know she is lying because I am a person of average intelligence. I mean come on!!

Anonymous said...

If she is lying fine...but what about the other people that have made the same allegations against these men? They can't all be lying. Anyone that has ever been around either of these men can clearly see they are capable of doing such things. Just because she lied about other things does not mean she is lying about this.

Anonymous said...

"can't all be lying"? First time I ever heard that- about inmates, media, or politicians!!! lmao

Anonymous said...

Where are all these people that made all these allegations against these men other than her? There are none. Period. ALL of the allegations are hearsay. No inmate has ever claimed to be Pregnant by the Chief. He has never been fired by anyone or any company, ever, regardless of what Attorney Paul Lavelle put in his letter of intent to file suit. It will all come out in the wash. I am certain there will be defamation of character suits coming from this. I am also certain this post wont be published to the blog, it seems the author/owner of this blog only post things that shine the light he/she wishes to shine. If it is, I stand corrected.
